Is It Legal to Buy a Personal Massager in India? What the Law Actually Says

Short answer: yes. No Indian law prohibits an adult from buying a personal massager for private use or owning one at home. India's obscenity provision targets the sale, public display and circulation of "obscene" material, and customs can stop obscene imports, but courts have recently held that massagers are not automatically obscene. Buy as an adult, from a seller in India, and use it privately.

This article explains the law in plain language for general information. It is not legal advice. Laws and their interpretation change, so for a specific situation please speak to a qualified lawyer.

Why people ask this question

Personal massagers have been sold openly online in India for years, yet many first-time buyers still wonder whether they could get into trouble. The confusion is understandable. India has no law that names these products at all, so people fill the gap with rumours. The honest picture is less dramatic: the law is concerned with obscenity in public and in commerce, not with what adults keep in their bedside drawer.

What Indian law actually covers

The obscenity provision: Section 294 of the Bharatiya Nyaya Sanhita

Since 1 July 2024, India's criminal code is the Bharatiya Nyaya Sanhita, 2023 (BNS), which replaced the Indian Penal Code. Section 294 of the BNS carries forward the old Section 292 IPC. It makes it an offence to sell, distribute, publicly exhibit, import, export or advertise "obscene" books, pictures, objects and similar material.

Three points matter for buyers:

  • It is about commerce and public circulation. The provision is aimed at selling, exhibiting and circulating obscene material, not at private ownership by an adult.
  • "Obscene" is decided case by case. The law defines obscenity as material that is lascivious, appeals to prurient interest, or tends to deprave and corrupt. In Aveek Sarkar v. State of West Bengal (2014), the Supreme Court said this has to be judged by contemporary community standards, looking at the material as a whole, rather than by the older and much stricter "Hicklin" test.
  • Personal massagers are marketed and sold as wellness products. Indian sellers, including Thrillerrr, sell them as personal massagers, ship them in plain packaging and do not display them publicly in an explicit way.

What courts have said recently

The clearest recent signal came from the Delhi High Court in late 2025. A Division Bench of Justices Prathiba M. Singh and Shail Jain was hearing a case in which customs officials had held back imported body massagers as "obscene" articles. The Court said that massage devices for personal care could not automatically be grouped with obscene material such as pornographic books or images, and that such decisions must rest on legal standards rather than subjective opinion. It ordered the goods released and imposed costs on the department. The judgment concerned a commercial importer, but its reasoning is the most direct statement so far on how Indian courts view these products.

Age requirements

The age of majority in India is 18 under the Indian Majority Act, 1875. Sellers set their own rules on top of that. Thrillerrr's Terms of Service require you to be 18 or older to shop, and the age gate on the website currently asks visitors to confirm they are 21+. If you are unsure, follow the stricter of the two. Under no circumstances should these products be bought for, or shared with, anyone under 18.

Buying online in India vs bringing one from abroad

Buying from an Indian seller

This is the simplest route. The product has already cleared customs (or been made in India), you have a seller to contact if something goes wrong, and you get local warranty and replacement support. Thrillerrr delivers across India in plain, logo-free packaging; the shipping policy explains delivery times and charges.

Bringing one back from a trip

This is a grey area rather than a clear yes or no. Section 11 of the Customs Act, 1962 lets the government prohibit imports of certain goods, and a notification issued under it in 1964 bars the import of obscene articles. Whether a personal massager in your luggage falls within that is left to the judgment of the officer in front of you, and the Delhi High Court has cautioned against treating massagers as obscene by default.

There is no guarantee either way. If an officer decides an item is prohibited, it can be detained. Ordering from an Indian seller avoids that uncertainty altogether, and many international products cost more once you add the risk and the lack of local warranty.

Ordering from a foreign website

The same customs rules apply to parcels. A package can be held for inspection, and you may have to deal with duties, delays or a seizure. Again, buying within India removes the problem.

Gifting and sending a massager to someone else

Buying a massager as a gift for another adult is not illegal. A few practical and ethical points matter far more than any statute:

  • Consent first. Only send an intimate product to a partner who has said they would like one. Sending sexual items to someone who has not agreed can amount to harassment, and it is never a good surprise.
  • Adults only. The recipient must be over 18.
  • Check the address. If the recipient lives with family or shares a mailroom, ask where they would like it delivered. Plain packaging helps, but the name on the parcel is still theirs.
  • Cash on delivery for someone else is awkward. Prepaying spares the recipient a payment at the door. At the time of writing Thrillerrr also offers free shipping on prepaid orders.

What this means for you as a buyer

  • Buying and owning one as an adult for private use: not prohibited by any Indian law.
  • Using it in private: entirely your business.
  • Displaying or distributing sexual material publicly: this is what the obscenity provision targets, so keep products private.
  • Importing: possible but uncertain, because customs officers have discretion. Buying in India is the reliable option.
  • Gifting: fine between consenting adults.

Where to buy with confidence

Look for an Indian seller that publishes its policies, ships in plain packaging and offers a warranty and a way to contact a real support team. Thrillerrr's range, from first-time options to app-controlled models, is in the Bestsellers collection. If you are buying for a man, our guide to men's massagers explains the options.

Frequently asked questions

Is it legal to buy a personal massager in India?

Yes. No Indian law prohibits an adult from buying a personal massager for private use or keeping one at home. The obscenity provision in Section 294 of the Bharatiya Nyaya Sanhita targets the sale, public display and circulation of obscene material.

Are vibrators illegal in India?

There is no law that bans vibrators or personal massagers by name. Whether an item is "obscene" is decided case by case, and in 2025 the Delhi High Court held that massagers cannot automatically be treated as obscene. This is general information, not legal advice.

Can I bring a massager from abroad into India?

Thrillerrr ships in plain, logo-free packaging, so the outer box does not show the brand or the product.
